Terms & Conditions

The general terms and conditions of sale (GTC) shown below apply to sales by Dortee GmbH (hereinafter also referred to as "company" or "the company"). The GTC shown below relate exclusively to the company Dortee GmbH and every natural or legal person (customer) who makes a purchase on the www.pineapplebikes.ch / www.de.pineapplebikes.ch / www.fr.pineapplebikes.ch, also referred to as the Website. The terms and conditions can be changed at any time, and the user of the Website and the customer confirm that they know the applicable terms and conditions at the time of the order. By placing an order, the customer expressly agrees to all terms and conditions of the general terms and conditions that apply on the day of purchase.

ARTICLE 1 - PRODUCT ORDERS

Customers may place an order in various ways (Website, email, telephone, etc.). For orders on the Website, contractual information is presented in English, German or French. Orders on the Website are placed via a secured connection.

First, Dortee GmbH reserves the right for orders coming from a foreign country with a payment that present suspicious characteristics (suspicious credit card, banking risk, customs risk, etc.) not to proceed with delivering the order without additional verification, which may delay delivery times.

Second, the company reserves the right to cancel or refuse any order from a customer with whom there is a dispute pertaining to the payment of a prior order.

Third, the company holds the right to refuse any customer that is rejected by a form of a credit check.

Any customer order that has been confirmed by sending an order confirmation is considered to be firm and definitive as soon as it is received by the company.

Any modification of an order for any reason whatsoever requires prior written approval by the company. The delivery of an order will only be made upon the full signing of the contract by the customer and with a firm financial commitment from said customer.

ARTICLE 2 - APPLICABLE PRICES, PRICE CONDITIONS AND PRACTICES

All prices quoted are public prices and are expressed in Swiss francs and include tax. At this stage we do not allow orders from people outside of Switzerland. All orders, regardless of their origin, are payable in Swiss Francs. The company reserves the right to change its prices at any time. However, each product purchased will be billed based on the prices in effect at the time the customer order was recorded. The price to be paid by the customer is in any case the price stated on the Website at the time of purchase as well as in the order confirmation and the corresponding invoice.

ARTICLE 3 - AVAILABILITY OF THE PRODUCTS

Our product offers and prices are valid as long as they are visible on the Website, limited to the available stock. Our product offerings are limited to the available stock. We will try to publish inventory availability on our Website in real time. In any case, you will be given information on the availability of the products at the time of your order. If a product is not available after you have placed your order, the company will definitely provide a new delivery time or cancel your order immediately after receiving the information. In this case, the customer can cancel the order and receive a refund for any advanced payment made to the company. Refunds will be made at the discretion of the company by crediting the customer's bank account. In the event of bankruptcy, the company reserves the right to cancel all or part of an order that has already been paid, and in this case is obliged to reimburse the customer for amounts already paid.

ARTICLE 4 - DELIVERY OF THE PRODUCTS

Any order will only be processed after the customer has passed a credit check and signed the final contract, or paid by the usual means of payment indicated on the Website (credit card etc.). The company reserves the right not to deliver an order if there is continued doubt as to the integrity of the payment by the customer.

Delivery of products ordered is made to the delivery address indicated by the customer during the ordering process. The company may not be held responsible for errors in the delivery address provided by the customer.  

The normal delivery time is 1-2 weeks. These times correspond to the normal processing and delivery times for Switzerland. All agreed delivery dates are guidelines and non-binding. The company is entitled to make partial deliveries at any time. Claims for compensation in the event of any delays or omitted delivery cannot be granted in our role as a distributor. Cancellations in the event of delays are not automatically possible and must be discussed on a case-by-case basis.

ARTICLE 5 - PAYMENT

5.1 Payment. Payment for the Products may be made either by the usual means of payment indicated on the Website (credit card, etc.) or by external financing under the terms of Article 7.2 below.

5.2. Requests for financing. You may request 0% financing from our partner. In order to do so, you must submit an offer to such partner, which shall be subject to acceptance by that partner, with whom you must then conclude a contract. The financing agreements are exclusively subject to the contractual terms and conditions of our partner Bob Finance. We are not a party to that agreement and disclaim all liability in connection with the loans or credit lines requested from financing partners. The procurement of financing is subject to conditions to be determined by the chosen partner (particularly in terms of the place of the borrower's domicile, his or her creditworthiness and other factors). You must provide the required information and documents.

ARTICLE 6 - REFUND AFTER CANCELLATION & RETURN

In accordance with the applicable law, the customer has a cancellation period of 14 days from the date of the order on our Website. However, the cost of returning the product is the responsibility of the customer, who must ensure that the product is delivered by secure delivery from a carrier who specializes in high quality items. Refunds can be made using the same payment method used to purchase or another payment method at no additional cost to the customer.

ARTICLE 7: SECURING PAYMENT METHODS

The Website is subject to a secure system for payment methods and personal data. We use SSL encryption, a payment platform and a range of encryption and encryption methods to protect all sensitive data regarding the payment methods as effectively as possible.

ARTICLE 8 - INTELLECTUAL PROPERTY

All texts, comments, writings, illustrations and pictures that are reproduced on the Website are protected worldwide as copyright as well as intellectual property rights.

ARTICLE 9 - NOTICE OF DEFECTS

The buyer must check the goods immediately upon receipt with all due care in terms of quantity, dimensions and quality and notify all defects within 10 days, after they receive the goods.

ARTICLE 10 - FACTORY GUARANTEE

All scooter are covered by the factory warranty for two years. During this period, the company (unless otherwise stated) undertakes to repair any major manufacturing defects free of charge at the time the scooter is delivered. However, a warranty does not cover: problems caused by an accident, problems caused by improper handling of any kind, problems caused by lack of care or by unauthorised use by third parties or possible damage caused by this, or problems caused by worn or damaged batteries, brakes, etc. Neither does the warranty cover wear and tear parts, such as brake pad, brake disc., charge interface, rear mirror, plastic parts (including PP), accelerator cable, tire, battery compartment cover and switch.

ARTICLE 11 - APPLICABLE LAW - DISPUTES

This contract is subject to Swiss law. In the event of a legal dispute, only the Swiss courts are responsible for the district where the company's headquarters are located.
